Terms of Service

Welcome to HuggsPOS. These Terms of Service (“Terms”) govern your access to and use of the HuggsPOS application, website, and related services (collectively, the “Service”) operated by PH Website Builders (“we”, “us”, or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

HuggsPOS is a cloud-based Point-of-Sale (POS) application designed for small and medium businesses. The Service allows you to manage sales transactions, inventory, employees, customers, and generate business reports through a web-based interface accessible on phones, tablets, and computers.

2. Accounts

To use HuggsPOS, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must be at least 18 years old or the age of majority in your jurisdiction to create an account.

Store owners may create sub-accounts for employees (cashiers, managers). The store owner remains responsible for all activity conducted through these sub-accounts.

3. Subscription Plans & Payments

HuggsPOS offers a free tier and paid subscription plans (Pro and Business). Details of each plan, including features and pricing, are available on our website and within the application.

• Paid subscriptions are billed on a recurring basis (monthly or annually) through our payment processor, Paddle.
• Prices are listed in US Dollars (USD) unless otherwise stated. Paddle may apply local taxes based on your location.
• Your subscription renews automatically at the end of each billing cycle unless you cancel before the renewal date.
• We reserve the right to change pricing with at least 30 days’ notice. Existing subscribers will be notified via email before any price change takes effect on their account.

4. Free Tier

The free tier provides access to core POS features with usage limits (e.g., maximum number of items, employees, and categories). We reserve the right to modify free tier limits at any time. We will endeavor to provide reasonable notice of any significant changes.

5. Your Data

You retain ownership of all data you enter into HuggsPOS, including product information, sales records, employee data, and customer records (“Your Data”). We do not claim any intellectual property rights over Your Data.

You grant us a limited license to store, process, and display Your Data solely for the purpose of providing the Service to you. We may also use aggregated, anonymized data for analytics and service improvement.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its related systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to store or transmit malicious code
• Resell, sublicense, or redistribute the Service without our written consent
• Interfere with or disrupt the integrity or performance of the Service

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. HuggsPOS includes offline functionality that allows continued operation during internet outages, with automatic data synchronization when connectivity is restored.

We may perform scheduled maintenance and will attempt to notify users in advance of any planned downtime.

8. Termination

You may cancel your account at any time by contacting us or through the account settings. Upon cancellation of a paid plan, you will retain access to paid features until the end of your current billing period, after which your account will revert to the free tier.

We may suspend or terminate your account if you violate these Terms or if your account remains inactive for an extended period (12 months or more). We will attempt to notify you before any involuntary termination.

9. Limitation of Liability

To the fullest extent permitted by law, PH Website Builders shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from these Terms shall be resolved in the courts of the Philippines.
